The information provided on the present website are given to the user to know more about Xavier Lersy, his skills and professional achievements.

I. 1- Any content or information is published without any intention to infringe the law, mislead the online visitor, malign governmental institutions, religions, ethnics, social groups, companies or individuals. Despite the efforts of publishing accurate information, Xavier Lersy cannot guarantee they are always up-to-date or totally correct.

I. 2- Despite the efforts of providing a website that ensures a secure and comfortable visit, the risk related to services or information is taken by the online visitor.

I. 3- Xavier Lersy shall bear no responsibilities in case of any damage, incident or any failure by using the website and its services meet by the visitor.

I. 4- The commercial names or brands related to software, engineering or graphic programs are given to the visitor as an indication of the skills by Xavier Lersy, who is not affiliated in anyhow to these mentioned brands or their affiliated companies.

I. 5- Individual responsibility: by browsing the website or purchasing a product from the present website, the visitor or user accepts without reserve to the Private Policy, Disclaimer and Terms and Conditions chapters. It is his/her responsibility to acknowledge of these chapters before any online journey or purchase.

“A creative but informative product”

The products or packages that can be purchased online are the creative works done by Xavier Lersy. They intent to deliver an idea of the possibilities to use the space of a land, how to combine the design elements altogether.

As Xavier Lersy, graduated of a master’s degree in marketing, is only an architecture enthusiast, consequently the products or packages can only give an information to the buyer of what could be his/her housing project.

As the purchases can be done worldwide, there are for the visitor, before any possible purchase, a few elements to consider:

II. 1- All products or suggested architectural concepts (structural, mechanical, plumbing or other tender layouts are excluded) are fully done by Xavier Lersy during his free time as a hobby. These works are not related to any company and Xavier Lersy owns the full rights related to the present concepts and their intellectual property.

II. 2- The plans (focusing on architecture only and listed in the table of deliverables within the packages and product description) are drafted by Xavier Lersy, who is graduated of a master’s degree in marketing. Despite he developed architectural drafting skills and being an architecture enthusiast, Xavier Lersy shall bear no responsibility at any moment of the implementation of the purchased product (in case the customer decides to build the purchased concept), whatever it is during the permit process at the Municipality, during the construction at the site or any other stage of the project.

II. 3- In any case, Xavier Lersy shall bear no responsibility, which includes the following circumstances (non-exhaustive list):

• if there are missing information to complete the permit process at the Municipality (the site plans with client's and neighbors lands, which is excluded from all packages, might be requested to complete the process)

• if any missing element in the set of layouts necessary for the construction work

• if any mistake happens at the site, during the construction phases of implementation of one of the present architectural concepts

• in any mistake during the construction phases that affects one of the original present concepts

• in any mistake that can happen at the site and related to MEP, HVAC, Plumbing, Mechanical, Electrical, Landscape or Finishes Works, since these elements are not included into any the present concepts packages (non-exhaustive list)

• in the case of any damage related to materials, the house itself, equipments or finishes that can appear during or after the construction of the house and its handover to the client

• in any worker accident or violation of the regulation of the country

II. 4- In the case the customer who purchased one of the concepts wants to build the suggested architectural concept, during the construction stage Xavier Lersy can be reached regarding clarification about the purchased concept or to obtain his feedback regarding the shop drawings drafted by the contractor. However, Xavier Lersy shall bear no responsibility in such a situation.

II. 5- All plans and documentation in the present packages are in English language. Xavier Lersy is not responsible for any misunderstanding from the customer’s side. For the customer to avoid such a potential misunderstanding, he/she can hire a professional translator (at his/her own expense) who can ensure the translation from English to his/her mother language.

II. 6- The “General Feedback” section in the set of drawings mentions the overall view of Xavier Lersy regarding the concept. This section needs to be understood as a general advice or point of view. It does not engage Xavier Lersy’s responsibility at all. The orientation (South for example) of the property is mentioned as a suggestion.

II. 7- The drawings within the packages are intended to give a suggestion of an architectural concept that can be implemented into the described plot size, by trying to deliver for the customer’s benefit an added value to the land. They cannot be the final layouts since this step requires the coordination with at least a structural consultancy office, who will take the full responsibility of the structural proposal and calculation.

II. 8- Despite the objective of delivering an added value to the land thanks to an attractive architectural concept, Xavier Lersy shall bear no responsibility in the case the land sees its value decreasing slightly or significantly. Indeed, many factors related to the market itself, which are out of control of Xavier Lersy, may lead to such consequences.

II. 9- The set of layouts in the packages are intend to cover the minimum requested plans to proceed to the permit licensing at the Municipality (excluding the Site Plans). However:

• the client must ensure the layouts are in compliance with the regulation with his/her country of origin

• the drawings need to be reviewed by a consultant/contractor regarding its technical feasibility in compliance with the existing conditions at the client’s site and its acceptance for the permit process

• since in any circumstances the layouts need to be reviewed first by an engineering office, Xavier Lersy cannot be responsible for any missing information in the layouts to complete the Municipality process or if completing the Municipality process takes longer time than usual

II. 10- The concepts and layouts are a general suggestion of building a house or a possible real estate investment. Since they are not drafted for a particular market or country, it is the responsibility of the client to verify along with a consultancy office chosen by him/her to verify the feasibility in his/her country with the local regulation.

II. 11- The proper execution at the site of the different needed works are the responsibilities of the consultancy offices, contractor and sub-contractors involved in the construction and chosen by the client.

II. 12- Detailed drawings need to be drafted by a third party/contractor. Such plans need to be considered by the parties involved in the project construction.

II. 13- The drawings indicate the general guidelines of the concept in terms of architectural design, the dimensions of the rooms and the property itself, and the main architectural elements for the structural engineering office to draft the structural calculation and layouts accordingly. To implement the purchased concept with full performance, the draft of detailed shop drawings by a third party/contractor or engineering offices is a must.

II. 14- To implement properly the suggested concept at the site, the contractor has the responsibility to lead a Topographic Land Survey and verify the main elements are in compliance with the existing conditions. The contractor has the responsibility to implement elements such as a ramp access for example among other element.

II. 15- The stories levels and natural ground level indicated on the Elevations Plans need to be coordinated with the Topographic Land Survey and existing site conditions. This is the full responsibility of the contractor to verify carefully these elements before any site work commencement.

II. 16- The present architectural layouts in the packages need to be coordinated with the structural drawings and tender layouts, under the full responsibility of the contractor.

II. 17- All levels and dimensions in the packages layouts are indicated in meters unless otherwise noted.

II. 18- All angles in the packages layouts are indicated in degrees unless otherwise noted.

II. 19- The drawings in the packages show conceptual architecture intent. It is the responsibility of the contractor to verify them at the site.

II. 20- The contractor is fully responsible for the work done at the site.

II. 21- The lift (if any in the conceptual proposal) depth needs to be determined by the consultant/contractor in compliance with structural requirements and lift manufacturer specifications.

II. 22- The contractor is fully responsible of the completion of shop drawings and the staff involved into it.

II. 23- The furniture and dimensions plans exclude the interior finishes (for example wall finishes) and client’s final furniture selection.

II. 24- The 3D renderings are done by Xavier Lersy and they intent to present the final expected result. Xavier Lersy shall bear no responsibility in case of discrepancies between the initial 3D renderings and the final result at the site.

II. 25- All drawings in the packages are drafted for fitting a printout into A3 format. Any adjustment to other format or printed copy is upon contractor’s cost and staff.

II. 26- Involving Xavier Lersy into drafting a 3D/BIM model, an interior design or furniture/interior decoration accessories researches assignments can be possible upon a mutual agreement by using the contact form at www.xavierlersy.com/contact.

II. 27- In the case of implementation of the purchased concept by the customer in an effective construction project, a plate or advertising mentioning “Concept imagined by www.xavierlersy.com" should be present at the site (after a mutual agreement between the client and Xavier Lersy regarding its size, its design and the plate material; the printing of such a plate is on Xavier Lersy’s cost, unless the client mentions clearly by written he/she can afford such an expense). Xavier Lersy has the right to not display a plate at the site.

ALL ABOVE POINTS RELATED THE WEBSITE IN GENERAL (CHAPTER 1) AND THE SHOP OR PURCHASES (CHAPTER 2) ARE UNDERSTOOD AND APPROVED BY THE VISITOR OR CUSTOMER UNCONDITIONALLY.
